ZONING BOARD OF ADJUSTMENT
SUNAPEE, NH
      
March 28, 2006

MEMBERS PRESENT: JAMES LYONS, VICE CHAIRMAN  PETER URBACH, DON WEATHERSON, ROBERT HENRY, ALTERNATE, HARRY GAZELLE AND ROGER LANDRY , ZONING ADMINISTRATOR.

Richard Guyer , Alex Kish, and Svend Filby were absent.

The meeting was called to order at 7 P.M. by Vice Chairman, James Lyons. Harry Gazelle was designated to vote in place of Richard  Guyer at this meeting.

The election of Chairman and Vice Chairman was delayed until April 13, 2006 as per the
Rules of Procedure.

MINUTES :   The minutes of  March 9, 2006 were reviewed. There were two corrections. On the third line on Case # 06-9,  the spelling of the word Their was corrected.
On page 3,  in the  last paragraph, the third sentence will read ,  “The Board asked that the excavating would be from within the foundation boundary.” Don Weatherson made a motion to accept the minutes as corrected. Bob Henry seconded the motion. The vote was in the affirmative.

There was no Planning Board report.

Don Weatherson made a motion  to start  the hearings. Harry Gazelle seconded the motion . All were in favor.

PUBLIC HEARINGS :  Case # 06-11. Avis Buecking. Map # 127. Lot # 4. Special Exception. Art. III. 3:50 I. Change the existing roofline and add a second floor for residential use. 23 Clearwater Dr. Sunapee. Kevin Hendricks presented the case. The applicant was  present. The roof pitch will be the same. The plan is that the roof  will be all one level and higher. It will be less than 25’. Bob Henry asked about the finished grade. James Lyons questioned the fact that Clearwater Drive goes through the property. Mrs. Buecking owns the pie shape corner. The Town abandoned Clearwater Drive . There is 25% coverage of the property. Bob Henry said that parking is not an issue.
Rock has been broken  up because it interfered with the foundation. This was done below the first floor and the first floor is not liveable. The Public input closed at 7: 20 P.M. Harry Gazelle made a motion to approve the request of Avis Buecking.. Case # 06-11. Map # 127. Lot # 4.  Special Exception. Art. III. 3:50 I. Change the existing roofline and add a second floor for residential use. 23 Clearwater Dr. Sunapee. Don Weatherson seconded the motion. There were five yes votes.

Case # 06-12.  Avis  Buecking. Map # 127. Lot # 4. Variance. Art . III. 3:40 C. Reduce lakefront setback from 50’ to 36’ to accommodate construction of a new entrance deck. 23 Clearwater Dr. Sunapee. The new entrance is requested because the existing one is rotting. The contour of the land has caused the rot problem. The new deck entrance would  be partially in the 50’ setback. She was planning to have the stairs set back further from the Lake and have the entrance on the side of the house. The front entrance deck will be removed. Bob Henry is concerned that the allowable 150 sq. feet would be taken up by the lower deck. A proposed walkway can be no higher than 2’. above ground. Mrs. Buecking said she is giving up about 75’ A portion of the walkway would be outside the 50’ setback. She wants to change the entrance also, because of the sloped ledge. She wants to create a safer access to the building. There was some discussion of
how much infringement there would be and the net amount of coverage .The Board went over the five conditions for the variance. There was concern because one deck had already been removed. The Board feels that there should be improved documentation of what had been there . It was decided that the case should be continued. The Kittle family approved of the plans. Peter Urbach made a motion to continue Cases # 06-12  and 06-13
to the next meeting. Robert Henry seconded the motion. There were five yes votes.

Don Weatherson made a motion to adjourn at 8:08 P.M. All members present were in favor.
